Expert Body Set Up by Madras HC to Counter Duplicate Accident Claims

The Madras High Court has come down heavily on the illegal and unethical practices that are taking place with regards to multiple insurance claims being filed for road accident cases. These cases are becoming rampant in the judicial system due to the involvement of lawyers and touts in the process.

The court has now appointed an expert body that will look into the matter; which will be headed by retired judge K. Chandru. The order came about when Justice P. N Prakash was hearing a petition filed by a general insurance company that was seeking investigation into a scam involving multiple claims filed for road accident deaths using fabricated FIR copies.

The insurer also stated in an affidavit that there were 353 Motor Claims Tribunal Original Petitions (MCOPs) that came under duplicate claims pertaining to five other insurance companies throughout Tamil Nadu. The Madras HC also lambasted the manner in which advocates were handling MCOP cases, sometimes signing case papers without even seeing the parties.

The expert body will be responsible for scouring motor accident claims in order to identify the pitfalls and suggest solutions that will end the menace of duplicate cases. The HC also directed the panel to report duplicate claims on same accident and identify the counsels behind them.

Justice P. N Prakash also ordered handing over the investigation of FIR filed for 55 missing MCOP case bundles to CB-CID police.
